Dr. Benjamín Gutiérrez has established himself as a leading legal strategist in Costa Rica and internationally. With more than 28 years of experience and a strong entrepreneurial vision, he has redefined the traditional practice of law by integrating technology, predictive analysis, and strategic risk management into the core of his professional approach.
Dr. Gutiérrez holds a Ph.D. in Commercial Law and Civil Procedure, graduating summa cum laude. His doctoral dissertation, “The Due Diligence Contract: Its True Legal Nature,” provides both academic and practical insight into investment processes, mergers and acquisitions, and corporate structuring. His doctoral training not only reflects technical rigor, but also strengthens his ability to design innovative, legally sound solutions for complex business challenges.
As Founding Partner of BGA Abogados since 1997, he has led the firm under a distinct philosophy: moving beyond the traditional law firm model to build an efficient, technology-driven organization focused on measurable results. This vision has enabled him to direct more than 3,600 judicial proceedings nationally and internationally, maintaining a success rate exceeding 99%, and positioning him among the most experienced litigators in civil, commercial, and corporate matters.
From the outset of his career, he has advised major national and international companies, including Holcim, Productos de Concreto, Concretera Nacional, Mexichem, Pretensados Nacionales, Grupo Progreso, and Grupo Leumi, among others. His work has strengthened his expertise in corporate law, private and administrative contracting, civil litigation, credit recovery, and complex corporate structuring.
He has also served as outside counsel to prominent public institutions such as the National Bank of Costa Rica, Banco Popular, Banco de Costa Rica, the Costa Rican Social Security Administration, the Municipality of San José, and FODESAF. In addition, he has acted as external notary for various government entities—demonstrating the institutional trust placed in his legal judgment.
His extensive experience in real estate and condominium law has led him to advise landmark development projects for leading real estate groups such as Garnier & Garnier, Grupo Leumi, Amador Inmobiliaria, Civitar, and other high-end residential developments. As a result of this work, he developed proprietary technological tools designed to structure, control, and monitor real estate projects with precision, significantly reducing operational risk.
Internationally, Dr. Gutiérrez was appointed in 2006 as Legal Director for Spain and Latin America of the International SEK Institution. In 2007, his responsibilities expanded when he became Global Legal Coordinator (Chief Legal Officer) of the SEK-IES Group, overseeing legal strategy across Africa, the Americas, and Europe. In this role, he has directed comprehensive legal operations for educational, corporate, sports, real estate, and food service businesses across multiple jurisdictions.
His professional trajectory has made him a frequent legal commentator for national media and a regular speaker on strategic litigation, corporate law, crisis management, legal innovation, and the application of artificial intelligence in legal practice.
