In Costa Rica, for a marriage to be legally recognized, it must be celebrated before a Catholic priest, a civil judge, or a notary public, and subsequently registered in the  in the Civil Registry.

Getting married in Costa Rica: Marriage Requirements

Regardless of whether the parties are Costa Rican or foreign, they must meet the following requirements:

• Be over eighteen years of age.
• Be in a state of freedom, meaning that none of the contracting parties may be bound by a previous marriage.
• Have voluntary or cognitive capacity at the time of the wedding, meaning that the spouses must be in full use of their mental faculties to expressly consent to their desire to marry.
• Have two witnesses who testify under oath about the freedom of state and legal capacity of the spouses.

The birth and civil status of Costa Ricans will be verified by processing and obtaining birth and civil status certificates issued by the Civil Registry.

In the case of foreigners, they must provide a complete copy of their current passport and issue a notarized affidavit in which they declare, under penalty of perjury, that they are in a state of freedom to contract marriage.

Prohibitions to get married in Costa Rica

It is important to keep in mind that in Costa Rica, marriage is legally impossible in the following cases:

• Between people who are still married, regardless of how long they have been separated.
• Between ancestors and descendants by consanguinity or affinity.
• Between consanguineous siblings.
• Between an adopter and the adopted and their descendants; adoptive sons and daughters of the same person; the adopted and the sons and daughters of the adopter; the adopted and the former spouse of the adopter; and the adopter and the former spouse of the adopted.
• For those who are under 18 years of age.

Is it possible to get married while pregnant?

The answer to whether a pregnant woman can get married is a resounding yes!

Children born within one hundred and eighty (180) days from the celebration of the marriage or the meeting of the legally separated spouses are presumed to be born in wedlock.

However, it’s important to note that if the woman is divorced, children born within three hundred (300) days after the dissolution of the marriage or the separation of the spouses will legally be presumed to be children of the previous marriage.

To avoid any potential inconveniences for all parties involved, if the bride has been divorced less than 300 days ago, she should provide a medical certificate stating that she is not pregnant, which will be included in the marriage certificate.

This small but crucial step will help avoid any presumptions of parenthood that could arise.

Is it possible to get married through a proxy?

Article 30 of the Costa Rican Family Code allows for a marriage to be celebrated through a proxy with an «exceptional power of attorney» granted in a notarized public deed.

The proxy must expressly state the name and general qualities of the person with whom the marriage will be celebrated, and it is a legal requirement that the other party attend the celebration in person.

Warning. However, please note that this type of marriage will no longer be allowed in Costa Rica from the effective date of the Family Procedural Code, which is estimated to be on October 1st, 2024.

From this moment on, the marriage can only take place with the appearance of both parties on the spot.

What is delivered to the spouses after the ceremony is over?

The notary public in charge of celebrating the union will request both parties and the witnesses to sign the notarial protocol.

The contracting parties will receive a testimony signed and sealed by the notary.

However, the marriage will not acquire legal validity until it is registered in the Civil Registry, for which the notary has eight days to present the corresponding testimony and form.

The registration process will take approximately three weeks.

Is it possible to sign a prenuptial agreement before getting married in Costa Rica?

Yes. In Costa Rica, marital capitulations (also known as prenuptial agreements) can be granted before or during the existence of the marriage and can cover present and future assets.

To ensure its validity, the agreement must be recorded in a notarized public deed and registered in the Public Registry under Article 37 of the Costa Rican Family Code.

Even after the marriage has taken place, both spouses can modify the capitulations as needed.

If the couple decides not to sign a prenuptial agreement, each spouse will retain ownership of all assets acquired before getting married and can dispose of them as they wish.

In the event of a dissolution of the marriage, each spouse is entitled to participate in half the net value of the community property established in the other’s assets.

These assets will be chained from the declaration to the results of the respective liquidation. If needed, Family Courts can provide annotation of claims on community property in the Public Registries and inventories deemed pertinent.

Is it possible to register a foreign marriage in Costa Rica?

Yes. If at least one of the spouses is Costa Rican, it’s possible to register a foreign marriage in Costa Rica.

All it takes is a request from at least one of the spouses and the submission of the original certificate issued by the corresponding authority in the country of origin, duly apostilled.

Keep in mind that if the document is not in Spanish, it must be translated by an official translator

Where can a marriage take place in Costa Rica?

A Costa Rican notary public can celebrate a marriage throughout the national territory, without any limitation in this regard.

Accordingly, the ceremony can take place in any office, house, hotel, beach, mountain, or wherever the couple and their loved ones decide.

Sin importar que los contrayentes sean costarricenses o extranjeros, todos deben cumplir con los siguientes requisitos:

1. Ser mayores de dieciocho años de edad.
2. Estar en libertad de estado, es decir, ninguno de los contrayentes puede estar ligado matrimonio anterior.
3. Contar con capacidad volitiva o cognoscitiva al momento de celebrarse el matrimonio, es decir, los contrayentes deben estar en pleno uso de sus facultades mentales para consentir expresamente su deseo de casarse.
4. Contar con dos testigos que den fe bajo juramento sobre la libertad de estado y aptitud legal de los contrayentes.

La comprobación del nacimiento y estado civil de los costarricenses se llevará a cabo mediante la tramitación y obtención de certificaciones de nacimiento y estado civil emitidas con Registro Civil.

En el caso de los extranjeros, deberán aportar una copia completa de su pasaporte vigente y emitir una declaración jurada notarial en la que, apercibidos de las penas de prisión que castigan el falso testimonio, declaran estar en libertad de estado para contraer matrimonio.

Prohibiciones para contraer matrimonio civil en Costa Rica

Es importante tener presente que en Costa Rica el matrimonio es legalmente imposible en los siguientes supuestos:

1. Entre personas que aún se encuentran casadas, sin importar que tengan mucho tiempo de estar separadas.
2. Entre ascendientes y descendientes por consanguinidad o afinidad.
3. Entre hermanos consanguíneos.
4. Entre quien adopta y la persona adoptada y sus descendientes; hijos e hijas adoptivos de la misma persona; la persona adoptada y los hijos e hijas de quien adopta; la persona adoptada y el excónyuge de quien adopta, y la persona que adopta y el excónyuge de quien es adoptado.
5. De quien sea menor de 18 años de edad.

¿Es posible contraer matrimonio en estado de embarazo?

Una mujer embarazada puede contraer matrimonio sin ningún inconveniente.

Para tales efectos, se presumirá como habido en el matrimonio aquellos hijos que hayan nacido dentro de los ciento ochenta (180) días contados desde su celebración o desde la reunión de los cónyuges separados judicialmente.

Asimismo, es importante tener presente que si la mujer es divorciada, se presumirán como hijos del matrimonio anterior los nacidos dentro de los trescientos (300) días siguientes a la disolución del matrimonio o a la separación de los cónyuges judicialmente decretada.

En caso que la mujer que vaya a contraer matrimonio tenga menos de 300 días de divorciada, es conveniente que aporte un certificado médico que haga constar que no está embarazada, de lo que se hará constancia en el acta de matrimonio, lo que evitará posteriores presunciones de paternidad que pueden resultar muy molestas para todos los involucrados.

¿Es posible casarse por medio de un apoderado?

El artículo 30 del Código de Familia permite que un matrimonio pueda celebrarse por medio de un apoderado con poder especialísimo que haya sido otorgado en escritura pública notarial, en la que debe constar expresamente el nombre y calidades generales de la persona con quien éste haya de celebrar el matrimonio, siendo requisito legal que concurra a la celebración en persona el otro contrayente.

Advertencia: Este tipo de matrimonios será prohibido en Costa Rica a partir de la entrada en vigencia del Código Procesal de Familia, lo que se estima será el 01 de octubre de 2024. A partir de este momento, el matrimonio solo podrá celebrarse con la comparencia de ambos contrayentes en el acto.

¿Qué se entrega a los contrayentes una vez concluida la ceremonia?

El notario público encargado de celebrar la unión solicitará a ambos contrayentes y a los testigos que firmen el protocolo notarial. A los contrayentes se les entregará un testimonio firmado y sellado por el notario, pero el matrimonio adquirirá validez legal hasta que se inscriba en el Registro Civil, para lo cual el notario tiene ocho días para presentar el testimonio y formulario correspondiente.

El trámite de inscripción demorará aproximadamente tres semanas.

¿Es posible firmar un contrato prenupcial o capitulaciones matrimoniales antes de casarse?

En Costa Rica, las capitulaciones matrimoniales pueden otorgarse antes de la celebración del matrimonio o durante su existencia y comprenden los bienes presentes y futuros.

Tal y como regula el artículo 37 del Código de Familia, para que este convenio sea válido debe constar en escritura pública notarial e inscribirse en el Registro Público.

Las capitulaciones podrán ser modificadas después del matrimonio por voluntad de ambos cónyuges.

Si la pareja decidiere no firmar capitulaciones, cada cónyuge será dueño de todos los bienes que haya adquirido antes de contraer matrimonio, pudiendo disponer libremente de ellos y de sus frutos.

En caso de disolución del vínculo, cada uno de los cónyuges adquirirá el derecho de participar en la mitad del valor neto de los bienes gananciales constatados en el patrimonio del otro.

Tales bienes se considerarán gravados de pleno derecho, a partir de la declaratoria a las resultas de la respectiva liquidación.

Los tribunales, de oficio o a solicitud de parte, dispondrán tanto la anotación de las demandas sobre gananciales en los Registros Públicos, al margen de la inscripción de los bienes registrados, como los inventarios que consideren pertinentes.

¿Qué trámites se hacen en el Registro Civil en Costa Rica para casarse?

El Registro Civil en Costa Rica es la institución encargada de llevar el control de los actos civiles, como nacimientos, matrimonios y defunciones. Si estás planeando un matrimonio civil, es fundamental entender qué documentos y requisitos se deben presentar ante el Registro Civil o ante el notario autorizado.

¿Es posible inscribir en Costa Rica un matrimonio extranjero?

En Costa Rica es posible inscribir matrimonios celebrados en el extranjero cuando al menos uno de los cónyuges sea costarricense, y cuando sea solicitado por al menos uno de ellos.

El procedimiento de inscripción exige la aportación del certificado original emitido por la autoridad correspondiente en el país de origen, debidamente apostillado, y en caso de haber sido expedido en un idioma distinto al español, deberá traducido por un Traductor Oficial.
